On November 7, 2023 the Office of Childhood received a report alleging "On 12/05/23 I visited All About Kids Academy around 11:45am for a scheduled tour. When we walked in the nursery, most infants were asleep in a circle sleeping on pillows. One infant had managed to slip himself half off the pillow, with his head and shoulder only left on the pillow while asleep with no intervention from staff. Another infant was asleep in a swing with her head rolled to her right side, resting on the strap with her neck." After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found this allegation to be substantiated based on the following evidence and rule violation:
5 CSR 25-500.092(1)(B)2.I which states "Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time."
On December 8, 2023 Compliance Inspector (CI) Caylin Mertz conducted an unannounced inspection at the facility. CI Mertz observed Child A to be asleep in an infant swing. Director Amber and Caregiver Ava indicated Child A eats while sleeping in the swing as that is the only way he will take a bottle at the facility. Parent A (Child A's Mother) indicated she did give the facility permission to feed him in the swing even if he is asleep but has since been told by the facility this is not allowed.
