Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that Child A (5 years old) had bruising on both her upper arms on the underside near Child A's arm pits. The allegation is substantiated based on the following information.
5 CSR 25-500.182(1)(C)3. which states, "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions."
On December 14, 2023, CI Greer interviewed Director Ashley Campbell, who stated she attempted to take Child A from Caregiver Breanna's arms. She had her hands under Child A's arms and was attempting to reposition her to a more comfortable/secure carry. Child A went "dead weight". She was afraid she was going to drop her and didn't want her to get injured. Director Campbell carried Child A from the pre-k room to her office which was approximately 15 feet. She sat on the ground with Child A who was still screaming. Director Campbell sat with Child A in her lap and Child A continued to scream and was trying to kick at her. Director Campbell crossed her legs over Child A's legs to prevent her from kicking and injuring both of them, thereby restraining Child A.
AND
5 CSR 25-500.192(5)(A) which states, "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
On December 14, 2023, CI Greer interviewed Director Ashley Campbell, who stated marks were noticed on Child A at approximately 2:30 p.m. Parent A was notified at approximately 3:15 p.m. via phone that Child A had marks under her arms.
