Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that an employee was sleeping while holding a child at drop off on December 27, 2023 after 7:00 a.m. The allegation is substantiated based on the following information:
5 CSR 25-500.182(1)(A)1. which states "Caregivers shall not leave any child without competent supervision."
AND
5 CSR 25-500.182(1)(A)3. which states "Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises."
AND
5 CSR 25-500.182(1)(D)1. which states, "Infants and toddlers shall have constant care and supervision. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping."
On December 29, 2023, Compliance Inspector (CI) JD Greer interviewed LLC Member Carrie Sellers, who stated she received a call from Caregiver Harley Bowen, who stated she thinks Caregiver Tiffani Steele may have been drifting off in the classroom the morning of December 27, 2023. LLC Member Sellers reviewed camera footage and it appeared that Caregiver Steele was nodding off. LLC Member Sellers spoke with Caregiver Tiffany Steele, who said she was sleepy that morning and was starting to drift off.
On December 29, 2023, CI Greer reviewed video footage from December 27, 2023 of the infant room, and observed Caregiver Tiffani Steele was present with Child A (15 months old). No other children were present in the classroom. Caregiver Tiffani Steele is wearing a green short sleeve shirt and blue jeans. Child A is wearing a long sleeve shirt and blue jeans. At approximately 06:56:54, Caregiver Steele is sitting in a rocking chair holding Child A. Caregiver Steele appears to be sleeping as the rocking chair stops moving and her head drops to her chest. From approximately 06:56 to 07:06 a.m., Caregiver Steele is sitting in the rocking chair and not moving. At approximately 07:06 a.m., Caregiver Harley Bowen enters the classroom with another child. Caregiver Steele's rocking chair begins rocking at approximately 07:06 a.m.
