Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation that Phil Stotts brags about carrying a firearm within the facility. The allegation is substantiated based on the following information:
5 CSR 25-300.090 (1)(E) - Ammunition, guns, hunting knives, bows and arrows, or other weapons shall not be on the premises unless stored in a locked cabinet or closet.
On January 3, 2024, CI Radney conducted a telephone interview with Parent A/Reporter. He and Phil were childhood friends. Phil brags to him about carrying his firearm inside the daycare. He assumes Phil does carry it on him inside the daycare, because Phil basically carries it everywhere.
On January 3, 2024, CI Radney conducted interviews with Phil Stotts and Becca Stotts. Phil Stots reported he does carry a weapon here from time to time. He does have his concealed carry weapon (CCW) permit. He usually has it on his person. If he doesn't, he leaves it in the office on the counter or in a drawer. It is not in a locked cabinet. On January 5, 2024, CI Radney conducted a telephone call with Phil Stotts. He will consider locking his weapon in a cabinet inside the daycare or not carrying it at all on the premises. He understands he would have to bring in the weapon and leave with the weapon outside of child care hours. Child A was interviewed and did not provide any relevant information to the complaint.
On February 26, 2024, CI Radney conducted a telephone interview with Parent B. She has not observed Phil or any caregiver to carry a firearm at the daycare. She has no concerns with the allegations of the complaint. On February 26, 2024, CI Radney conducted a telephone interview with Parent D. She has not observed Phil or any caregiver to carry a firearm at the daycare. On February 26, 2024, CI Radney conducted a telephone interview with Parent E. She reported Parent A was not allowed at the daycare. She has no concerns with Phil or any caregiver carrying a firearm at the daycare. She has no concerns with the allegations in the complaint.
