On January 8, 2024, the Office of Childhood (OOC) received an allegation that on January 08, 2024 at 8:10am there was no heat in the building and the indoor temperature was 61 degrees Fahrenheit. After conducting an investigation, Compliance Inspector (CI) Jade Stewart-Martin and Compliance Inspection Supervisor (CIS) Marla Chrisco have found this allegation to be substantiated based on the following evidence:
5 CSR 25-500.082(2)(A)5., which states the following: "The facility shall be dry, temperature controlled, well-ventilated and free of drafts. Children shall not be overheated or chilled. The temperature of the rooms shall be no less than sixty-eight degrees Fahrenheit (68F) and no more than eighty-five degrees Fahrenheit (85F) when measured two feet (2') from the floor."
On January 08, 2024, CI Stewart-Martin and CIS Chrisco attempted an inspection, the facility appeared to be closed due to the lights being out and nobody answering the door. Later that day CIS Chrisco was able to get in touch with the assistant director, Mary Hermann, who stated that they were open and that when she arrived at the facility the morning of January 8, 2024, the heat was out and temperatures in the facility ranged from 61 degrees Fahrenheit to 65 degrees Fahrenheit. The owner had a company out and it was fixed by 9:30 A.M. so they remained open.
On January 10, 2024, CI Stewart-Martin and CIS Chrisco conducted interviews with teachers: Kayla Bettorf, Diana Audriuca, and Nicole Nicholson. All staff interviewed confirmed that the heat was in fact out on the morning of January 08, 2024. The staff interviewed confirmed that it was fixed somewhere in between 9:30 A.M. and 11:00 A.M.
On January 10, 2024, CI Stewart-Martin and CIS Chrisco observed the facility temperatures in each classroom. The temperatures ranged from 69 degrees Fahrenheit to 73 degrees Fahrenheit and were in compliance.
