5 CSR 25-500.182(1)(D)1. Infants and toddlers shall have constant care and supervision. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping.
Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that on Friday, January 5, 2024, at approximately 3:33 PM, 3 children in the IT Unit, specifically the Infant Room were left unattended for about 20 seconds. This allegation is substantiated based on the following rule violations. 5 CSR 25-500.182(1)(D)1. which states: "Infants and toddlers shall have constant care and supervision. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping." AND 5 CSR 25-500.182(1)(A)3., which states: "Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises." On January 11, 2024, CI Graham reviewed video footage with Jennifer Stotler, caregiver. The footage was 30 seconds long and showed the infant classroom. Haley Garrison was the caregiver in the room. Parent A and Grandparent A were standing in the classroom holding Child A. Chris Hayes, caregiver, walks in the classroom and then Haley exits. Chris then walks out of the room leaving no caregiver in the classroom. Haley walks back into the room within 20 seconds of Chris walking out. On January 11, 2024, Jennifer Stotler, director, and Chris Hayes, caregiver agreed that Parent A and Grandparent A arrived to pick up Child A. Parent A asked Haley Garrison, caregiver in the room, where Child A's sock was. Haley stepped in the doorway to ask Chris about the missing sock. Chris came into the room to look for the sock and while she was in there Haley had walked out, but Chris was unaware. The children were left unattended in the classroom for about 20 seconds. On January 16, 2024, Haley Garrison, caregiver, stated that she was in the room with the infants and Parent A came in to pick up Child A. She asked about a sock so Haley yelled for Chris to come in the room. When Chris came in the room Haley thought she was supposed to switch spots with Chris so she went out of the room. Chris walked out and Haley realized that no caregivers were in the room so she walked back in.
