Compliance Inspector (CI) Jessica Graham investigated the allegation that on Friday, January 16, 2024, Miss Brooke gave Child A, age 2-years-old, a melatonin gummy to make him fall asleep without parent permission. This allegation is substantiated based on the following rule violations:
5 CSR 25-500.192(3)(B) which states: "All medication shall be given to a child only with the dated, written permission of the parent(s) stating the length of time medication may be given."
AND
5 CSR 25-500.192(3)(E) which states: "All medication shall be stored out of reach of children or in a locked container."
AND
5 CSR 25-500.192(3)(I) which states: "The date and time(s) of administration, the name of the individual giving the medication and the quantity of any medication given shall be recorded promptly after administration. This information shall be filed in the child's record after the medication is no longer necessary."
On January 25, 2024, Ana Munoz, caregiver, said that she was told that Brooke Pind, caregiver, gave two sleeping gummies to Child A. Kaira Faire, caregiver, was working with Child A and said that she gave him a gummy as well.
Brooke said that she thought about giving Child A a melatonin gummy to help him sleep during nap time but decided against it. She keeps gummies in her purse for her daughter and thought she would give one to Child A because she was leaving the classroom and wanted him to sleep for the teacher coming in. She did not give him the gummy but put it in her desk drawer. Kaira was coming into the classroom to cover for her break and she told her that she could give Child A a gummy at nap time to help him sleep. There was not a medication form on file for Child A to have a gummy and there was no parent permission.
Kaira stated that she went in to cover break for Brooke and Brooke told her that she gave Child A two melatonin gummies and that there were two more in the desk drawer if she needed them for later. At 11:00am Kaira gave Child A a gummy to help him rest for nap. After giving him the gummy, she realized that was not the right thing to do. She did not have any medication form or parent permission to give the gummy to Child A. She told her coworker Ana that she gave Child A the gummy and Ana told Kayla about it.
Parent A said he was made aware of the incident but was told that Child A was given a gummy by accident. He said no one had ever said anything to him before about giving Child A melatonin to help with nap time.
Director Kayla Byers stated that the incident was brought to her attention on Friday, January 19. 2024. She talked to all the caregivers involved. Brooke Pind is the main caregiver for Child A, age 2-years-old. She has never known any caregiver to give medication to a child without parent permission before. She told Parent A that Child A was accidently given the gummy because she felt it was one staff members word against another and she never had video footage or evidence whether Child A did or did not get the melatonin gummy. The one staff that gave him the gummy gave him an unwrapped gummy from the desk drawer and they were not clear what it was. It could have been a Welches gummy fruit snack. She did find a random gummy in Brooke's drawer after looking and Brooke said it could have come from her purse but she didn't say what it was exactly. She was still investigating herself when CI Graham spoke to Parent A and wasn't really sure what was going on. She has wrote up all caregivers and told them she would be checking on them in the classroom and having them watch a video on administering medication properly. She will also have all caregivers in the building do the same.
