Conclusion Summary
On January 2, 2024, Compliance Inspector (CI) Cole Eddins conducted an unannounced inspection regarding the allegation that therapists came into the school and witnessed Nazanin Keshmiri (teacher) grabbing Child A (4 years old) out of the chair. She yanked him several times and yanked him up off the floor by his arm. No known injuries. Child A sat on the floor after the incident and appeared to be frustrated.CI Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.182(1)(C)3. which states: "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions." On February 5, 2024, CI Eddins interviewed Director Chelsea Strutton and LLC Member Princess Harris. Chelsea Strutton and Princess Harris provided consistent information. They both stated that they did not observe the allegation firsthand. They stated that when they reviewed the footage, they observed Child A sitting down at a table playing with crayons. Nazanin Keshmiri talked to Child A and then she grabbed Child A's right arm. Nazanin Keshmiri lifted Child A out of his chair, and she forcefully guided Child A to the carpet where she sat him down with the other children. Nazanin Keshmiri tried to reposition Child A by lowering him on the ground and then raising him back up by his right arm so that he would better sit on his bottom. Nazanin Keshmiri grabbed Child A by both arms to lift him back up so that she could better reposition Child A's body to sit on his bottom. Chelsea Strutton and Princess Harris stated that this occurred on February 2, 2024, at around 11:04 a.m. and that the entire incident lasted about 15-18 seconds. On February 5, 2024, Compliance Inspector (CI) Cole Eddins reviewed footage from February 2, 2024, received from Princess Harris on February 5, 2024. Child A was playing with crayons as he sat at the table at the beginning of the video. Nazanin Keshmiri walked towards Child A and pointed her finger at him gesturing for him to go to the carpet. Nazanin Keshmiri grabbed Child A by his right arm and forcefully pulled him out of his chair to guide him towards the carpet where the other children in the classroom were currently sitting. Nazanin Keshmiri lowered Child A on the carpet and then pulled him back up by his right arm to reposition him. Child A then fell down on his knees as Nazanin Keshmiri picked him back up by his right arm in an up and down yanking motion. Child A fell back down on his knees when Nazanin Keshmiri grabbed Child A by both arms to forcefully reposition Child A's body to sit down on his bottom.
