On February 2, 2024, the Office of Childhood (OOC) received an allegation that the teacher Nicole Nicholson in the 2-year-old and 3-year-old room does not wash her hands and that the children do not wash their hands. After conducting an investigation, Compliance Inspector (CI) Ian Fyfe has found this allegation to be substantiated based on the following evidence:
5 CSR 25-500.192(6)(A), which states the following: "Caregivers shall wash their hands with soap and running water after toileting or assisting a child with toileting, after diapering a child, before food preparation or serving of food and at other times as needed."
On February 6, 2024, Compliance Inspector (CI) Ian Fyfe conducted an unannounced inspection to Kidsplay, LLC and interviewed staff members Mary Hermann, Nicole Nicholson, and Madaline Kiesey. Ms. Hermann and Ms. Nicholson provided consistent information regarding the reported concerns. Approximately two weeks ago, Ms. Hermann and Director Michelle Lombardino observed Ms. Nicholson not washing her hands in between each child's diaper change. Ms. Hermann and Ms. Lombardino addressed the issue with Ms. Nicholson and have not seen the issue since then.
On February 22, 2024, CI Fyfe interviewed Director Michelle Lombardino via phone call. Ms. Lombardino was familiar with the reported concerns. Another staff member told Ms. Lombardino about the concern. When she confronted Ms. Nicholson about the concern, Ms. Nicholson stated that she was using hand sanitizer on her hands, but not the children's, in between each diaper change and that she thought that this was enough. Ms. Lombardino told Ms. Nicholson that she needs to wash her hands and the children's hands properly in between each diaper change and has not seen the concern since then. She had no concerns regarding other staff members not washing their hands or the children's hands.
On February 6, 2024, and on February 26, 2024, CI Fyfe attempted to interview Amie Tighe via phone call but was unsuccessful.
