Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that on 2/8/2024, during nap time, some classrooms did not have a staff in the room while children were napping due to staff standing in the front of the building talking. This allegation is substantiated based on the following rule violation: 5 CSR 25-500.182(1)(A)5. which states: "A caregiver shall remain in the room with preschool and school-age children while they are napping or sleeping and shall be able to see and hear them if they have difficulty during napping or when they awaken." On February 8, 2024, Mike Massey with Department of Fire Safety arrived to the facility around 12:45pm to conduct an investigation. Upon arrival he noticed that a group of caregivers were gathered in the front room. He asked the caregivers if they were having a meeting and they all went back to their classrooms. As he was walking through the facility, he noticed that the same amount of caregivers that he saw in the front room were now in the classrooms, meaning the the napping children were left unattended. This was for the all the classrooms other than the infant and toddler unit. On February 20, 2024, CI Graham arrived at the facility during nap time, at 12:45pm, and all the classrooms had caregivers in each room with the children. Stacey Bertrand-McIntosh, managing member, said that she was not aware that this happened as she was not working on that day. The previous director, Ashley Miller, would have been in charge that day but is now no longer working at the facility. She will discuss this issue with all the caregivers that are working, but she felt that they should have known not to leave the children unattended.
