5 CSR 25-500.092(3)(A) All outdoor equipment shall be constructed safely, in good condition and free of sharp, loose or pointed parts. Only lead-free paint shall be used.
5 CSR 25-500.092(3)(D) Stationary equipment such as swings, slides and climbers shall be securely anchored, have no exposed footings and be placed to avoid accidents or collisions.
5 CSR 25-500.182(1)(C)3. Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions.
5 CSR 25-500.182(1)(C)8. No discipline technique which is humiliating, threatening, or frightening to children shall be used. Children shall not be shamed, ridiculed, or spoken to harshly, abusively, or with profanity.
5 CSR 25-500.182(2)(B)4. A total of at least one (1) hour of outdoor play for children in attendance a full day unless prevented by weather or special medical reasons. (Based on wind chill factor or heat index, children shall not be exposed to either extreme element. ) ;
Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that the building is not up to code, chipped paint, windows that fall out, and outdoor equipment not maintained. This allegation is substantiated based on the following rule violations: 5 CSR 25-500.092(3)(A) which states: "All outdoor equipment shall be constructed safely, in good condition and free of sharp, loose or pointed parts. Only lead-free paint shall be used." AND 5 CSR 25-500.092(3)(D) which states: "Stationary equipment such as swings, slides and climbers shall be securely anchored, have no exposed footings and be placed to avoid accidents or collisions." On March 12, 2024, CI Graham observed the outside play structures. The large climber was wobbly in several places and appeared to have weathered wood. The swing structure was not secure to the ground and would lift while a child was swinging. CI did not observe any issues inside the facility regarding chipping paint or windows that fall out. Director Alie Coleman stated that she was cited for chipping paint in the building by her inspector but those violations have all been corrected. She did agree that the outdoor structures were getting older and could use some repairs. She will begin getting those things fixed.
