Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that Child A and Child B were napping in highchairs for approximately five minutes and the teachers did not notice them. The allegation is substantiated based on the following information:
5 CSR 25-500.092(1)(B)2.I. which states, "Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time."
On February 28, 2024, Compliance Inspector (CI) JD Greer interviewed Director Donna Smith, who stated on February 21, 2024, Grandparent A (Grandparent of Child A) saw Child A (12 months old) falling asleep in the highchair on camera. This occurred at approximately 11:40 a.m. Staff Kathy Decker received a call from Parent A (Parent of Child A) at approximately 11:45 a.m. saying that Child A and Child B (13 months old) had been asleep in their highchairs for approximately five minutes and the teachers had not moved them. Caregivers Grace Caponetto and Haylee Castaneda were in Child A's room. Staff Decker went down to the classroom and had the caregivers move Child A and Child B out of their highchairs.
On February 28, 2024, CI Greer interviewed Staff Kathy Decker, who stated on February 21, 2024, Parent A called her to state that Grandparent A had witnessed Child A and Child B fall asleep on camera. Parent A stated that Child A had been asleep for approximately 5 minutes. Staff Decker informed Director Smith of what Parent A stated. Staff Decker immediately went down to Child A and Child B's classroom. Upon entering the classroom, she observed Child A and Child B had fallen asleep in their chairs. Staff Decker informed Caregivers Caponetto and Castaneda that the children were asleep and needed to be moved right away.
On February 28, 2024, CI Greer interviewed Caregiver Haylee Castaneda, who stated on February 21, 2024, Child A and Child B fell asleep in their chairs. Child A had been asleep for approximately six minutes and Child B for approximately two minutes. Staff Decker entered the classroom and informed Caregivers Castaneda and Caponetto that the two children needed to be moved to cots.
On February 28, 2024, CI Greer interviewed Caregiver Grace Caponetto, who stated on February 21, 2024, she was cleaning up and changing diapers in Child A and B's classroom. She was fully aware that Child A and Child B were falling asleep. She should have stopped changing diapers and helped move the children. Staff Decker came into the classroom and stated that Child A and Child B needed to be moved to cots as they were asleep.
