5 CSR 25-500.182(1)(C)7. Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited.
5 CSR 25-500.182(1)(C)9. Punishment or threat of punishment shall not be associated with food, rest, or toilet training.
Conclusion Summary
Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that Caregiver Aimee Lucas slapped Child A (2 years old) across the face. The allegation is substantiated based on the following information: 5 CSR 25-500.182(1)(C)3. which states, "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions." AND 5 CSR 25-500.182(1)(C)7. which states, "Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited." AND 5 CSR 25-500.182(1)(C)9. which states, "Punishment or threat of punishment shall not be associated with food, rest, or toilet training." On March 5, 2024, CI Greer interviewed Child A (2 years old). Child A was able to say her name. Child A was shown a picture of Caregiver Lucas. Child A looked at the picture and said, "Amy hit me." When asked where she was hit Child A pointed to her cheek. On March 5, 2024, Compliance Inspector (CI) JD Greer conducted an unannounced inspection and interviewed Managing Member Summer Borgmann, Director Kayla Cassidy, and Caregiver Avery Lies. Managing Member Borgmann stated on March 1, 2024, at approximately 1:30 p.m. she saw Caregiver Avery Lies, who was leaving her room for a break. Caregiver Lies appeared to be upset and Managing Member Borgmann asked her what happened. Caregiver Lies stated that Aimee (Caregiver Aimee Lucas) slapped Child A (2 years old). Caregiver Lies stated that she was restocking diapers in the bathroom and heard Caregiver Lucas say to Child A, "Do you want me to pull your hair?" Caregiver Lies came out of the bathroom and witnessed Caregiver Lucas slap Child A across the face. Child A began to cry. She believes Caregiver Lies is telling the truth. Caregiver Lies stated on March 1, 2024, she was in Caregiver Lucas' classroom bathroom stocking diapers. She believes that Caregiver Lucas was not aware that she was in the bathroom stocking diapers during nap time. She heard Caregiver Lucas say, "Do you want me to pull your hair out?" Caregiver Lies walked out of the bathroom and saw Caregiver Lucas sitting at a table and Child A was on her cot. Child A appeared to be restless and was moving around on her cot. Caregiver Lucas went over and sat down next to Child A's cot and slapped Child A in the face. Director Cassidy stated she believes Caregiver Lies is telling the truth about what she saw between Child A and Caregiver Lucas. On March 5, 2024, CI Greer reviewed an incident report for March 1, 2024, for Child A and observed the incident occurred at approximately 1:20 p.m. There were no marks on Child A. Description of incident states, I was stocking diapers in the bathroom. I heard Aimee (Lucas) say to Child A, "Do you want me to pull out your hair." Then I came out of the bathroom. She (Aimee Lucas) smacked Child A on the face and told her to lay down. I comforted Child A and made sure she was okay. I immediately told Summer (Borgmann) what happened. The name of the witness/reporter is Caregiver Avery Lies. The report is signed by Caregiver Avery Lies and Managing Member Summer Borgmann. On March 5, 2024 and March 19, 2024, CI Greer attempted to contact Caregiver Lucas. He left voicemail messages but received no return calls.
