Conclusion Summary
On March 11, 2024, the Office of Childhood (OOC) received the following allegations: Child A (4-years-old) had a huge scratch on their face. The incident happened at 2 PM and Parent A (parent of Child A) was informed by another child at pickup. Child A has had scratches and a black eye in the past and Parent A never got notified. Child A sometimes comes home with their pull up not changed. Child A once said another child had hit them and the daycare staff encouraged him to hit them back. After conducting an investigation, Compliance Inspector (CI) Ian Fyfe has found this allegation to be substantiated based on the following evidence: 5 CSR 25-500.192(5)(A), which states that: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." On March 13, 2024, Compliance Inspector (CI) Ian Fyfe conducted an unannounced inspection to The Learning Tree Development Center LLC and interviewed staff members Kristal Davis, Jacqueline Davis, and Jazzmine Gaines. All three staff members provided consistent information regarding the reported concerns. On February 29, 2024, at approximately 2 PM, Child A was pushed out of the bathroom by Child B (4-years-old) after both children tried to use the bathroom at the same time. Child A sustained one to three scratches on his face as a result. An accident report was completed after the incident and a copy was provided to Parent A (parent of Child A). According to the accident report, approximately seventy-five minutes passed between the incident occurring and Parent A being notified. Child A has not returned to the facility since the incident happened. Staff members denied concerns regarding Child A sustaining a black eye at the facility and not having his diaper changed properly. Child A was also never encouraged to hit another child back. On March 15, 2024, March 18, 2024, and March 20, 2024, CI Fyfe attempted to interview Parent A (parent of Child A) via phone call but was unsuccessful in each attempt.
