On March 11, 2024, the Office of Childhood (OOC) received a report alleging that on March 7, 2024, Child A (2 years old) was climbing on a stack of cots with two other children. Child A fell, hit his head, and his head snapped back. Child A's parent took Child A to the emergency room where Child A was treated for a gash on his head. After conducting the investigation, Compliance Inspector (CI) Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.082(1)(A) which states: "The premises shall be safe and suitable for the care of children."
On March 11, 2024, CI Cole Eddins conducted an unannounced inspection and interviewed Director Lacey Williams, Caregiver Emily Libich, and Caregiver Makenzze Johnson, who all provided consistent information. They stated that Emily Libich and Makenzze Johnson had observed children climbing on the stacked cots throughout the day on March 7, 2024. They stopped removing the children off the cots and addressing the climbing behaviors sometime in the afternoon. Child A was climbing on top of the stacked cots at around 4:40 p.m. on March 7, 2024, and Emily Libich and Makenzze Johnson did not tell Child A to get down. Child A fell off the cots and hit his head on the hard-tiled floor. Emily Libich and Makenzze Johnson observed a goose egg on Child A's forehead after he fell. Lacey Williams stated the cots are normally stacked in Child A's classroom and are typically around 2 feet high off the ground. The cots were not removed from the classroom.
On March 22, 2024, CI Cole Eddins conducted a walkthrough of the facility and observed a small bump and bruise on Child A's forehead. CI Eddins observed the cots to be stacked about 2-and-a-half feet high.
On March 11, 2024, Compliance Inspector (CI) Cole Eddins reviewed the video footage on March 11, 2024, on-site at Talented Tots-Parkville, LLC. Child A and another child were sitting on the stack of cots from the start of the video. It does not appear that the children are ever addressed or told to get off of the stacked cots. Child A did not climb off of the stacked cots and he was moving, bouncing, and squirming on the cots from 4:34:59 p.m. until 4:40:49 p.m. At 4:40:49 p.m., Child A fell off of the cots face first, onto the hard tile floor.

They stated that Emily Libich and Makenzze Johnson had observed children climbing on the stacked cots throughout the day on March 7, 2024. Emily Libich and Makenzze Johnson stated that no one observed Child A fall and hit his head and that Emily Libich had observed Child A on the ground crying near the cots. Lacey Williams stated the cots are normally stacked in Child A's classroom and are typically around 2 feet high off the ground. The cots were not removed from the classroom.
On March 22, 2024, CI Cole Eddins conducted a walkthrough of the facility and observed a small bump and bruise on Child A's forehead. CI Eddins observed the cots to be stacked about 2-and-a-half feet high.

Child A and another child were sitting on the stack of cots from the start of the video. Child A was rocking back and forth as he adjusted his body on the cots. Makenzze Johnson is sitting down with the majority of the children in the bottom left corner of the video just out of view. It does not appear that the children are ever addressed or told to get off of the stacked cots. Child A did not climb off of the stacked cots and he was moving, bouncing, and squirming on the cots from 4:34:59 p.m. until 4:40:49 p.m. At 4:40:49 p.m., Child A fell off of the cots face first, onto the hard tile floor. Emily Libich was facing towards the classroom sink and she had her back turned to Child A during the time that he fell.
On March 19, 2024, CI Eddins interviewed Parent A and Parent B. Parent A and Parent B provided consistent information. Parent A and Parent B stated that they believed Child A was not well supervised when he fell and hurt his head. Parent A and Parent B stated that Child A's behavior was not addressed, and that Caregiver Libich could have prevented Child A from getting hurt.
