This space shall be separated from the space used for older children by floor-to-ceiling walls;
5 CSR 25-500.182(1)(A)1. Caregivers shall not leave any child without competent supervision.
Conclusion Summary
Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation that Rashon left her classroom, leaving a Payton, a 17-year-old teacher, alone for close to two hours on February 2, 2024. Payton was left alone on February 23, 2024 for over 15 minutes; on February 26, 2024 for 10 minutes; and on March 5, 2024 for a significant amount of time. The allegation is substantiated based on the following information: 5 CSR 25-500.102(1)(C)1. - A Junior Aide-- 5 CSR 25-500.102(1)(C)1.A. - May count in staff/child ratio only if under the direct supervision of an adult caregiver within the same group of children; 5 CSR 25-500.102(1)(C)1.B. - Shall not have the direct responsibility for a group of children as the sole caregiver; On March 13, 2024, CI Radney interviewed Payton Dudek and Alexandria Rickman. Payton reported she is 17 years old. Rashon White has left her alone in the classroom a couple of times. Each time was about 15-20 minutes long that she was alone in ratio. Alexandra reported she has observed Payton alone in ratio for more than 10 minutes at a time. On March 19, 2024, CI Radney interviewed Rashon White. Rashon reported sometimes she has to go tot he bathroom and leaves Payton alone in ratio. It happens several times a day and for about 5-8 minutes each time. Junior Aide, Payton Dudek, counted in staff/child ratio and had direct responsibility for a group of children as the sole caregiver when Rashon White left her alone on several occasions for between five to 20 minutes of time.
