5 CSR 25-500.102(1)(E) Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care.
5 CSR 25-500.222(9) All records of children shall be confidential, protected from unauthorized examination, and available to the parent(s) upon request.
5 CSR 25-500.182(1)(D)3. Caregivers shall be alert to various needs of the child such as thirst, hunger,diaper change, fear of or aggression by other children, and the need for attention.
5 CSR 25-500.182(1)(E)4. Diapers and wet clothing shall be changed promptly.
Conclusion Summary
On March 25, 2024, the Office of Childhood (OOC) received a report alleging that on September 2023, an unknown teacher gave Child A (2 years old) cow's milk when Child A was allergic. Child A went to the emergency room and an EpiPen was administered. After conducting the investigation, Compliance Inspector Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.102(1)(E) which states: "Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care." On March 27, 2024, CI Eddins conducted an unannounced inspection and interviewed LLC Member Allison Linsey, who stated that Child A had an allergy to dairy. Caregiver J'Nariea Brockman had accidentally served Child A a sandwich with cheese and Child A had an allergic reaction. Child A's face swelled up and he was given an EpiPen at the facility by LLC Member Zoee Berry. J'Nariea was aware of Child A's dairy allergy and had given him the sandwich by accident. On March 27, 2024, CI Eddins conducted a walkthrough of the facility and observed two separate incident reports for Child A's accident which stated that Child A was accidentally served a cheese sandwich on September 13, 2024. On April 9, 2024, CI Eddins interviewed Zoee, Caregiver Armari Ellingburg, and Caregiver Tiara Spende'Wooten. Zoee, Armari, and Tiara provided consistent information. They all stated that they were aware of Child A's dairy allergy and that J'Nariea had accidentally given Child A a sandwich with cheese on September 13, 2024. Child A's face swelled up soon after lunch and Child A was rushed to Zoee, who administered an EpiPen to Child A. and 5 CSR 25-500.132(6) Which states: "A child who has a special physical, developmental, or behavioral need shall have on file an individualized plan for specialized care from a professionally qualified source." On March 27, 2024, CI Eddins interviewed LLC Member Allison Linsey. Allison stated that Child A's parent didn't provide anything signed by a doctor regarding Child A's allergies and what to do if Child A was exposed to an allergy. On March 27, 2024, CI Eddins observed several documents in Child A's file that stated that Child A could not have cow's milk. None of the documents were signed by a medical professional. CI Eddins did not observe an Individualized Plan for Specialized Care. and 5 CSR 25-500.222(9) which states "All records of children shall be confidential, protected from unauthorized examination, and available to the parent(s) upon request." On March 27, 2024, CI Eddins interviewed LLC Member Allison Linsey, who stated Child A's allergies were posted in his classroom. On March 27, 2024, CI Eddins conducted a walkthrough of the facility and observed the classrooms to have their current children's allergies posted on their walls. On April 9, 2024, CI Eddins Interviewed Zoee and Caregiver Armari Ellingburg, who both stated Child A's allergies were posted in his classroom.
