On March 25, 2024, the Office of Childhood (OOC) received an allegation that on March 26, 2024, Tori hit a 1-year-old child in the head with the classroom door leaving a goose egg and a red mark on her forehead. Tori then proceeded to tell her to stop crying and refused to write an incident report for it. After conducting the investigation, Compliance inspector (CI) Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.192(5)(A). which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
and
5 CSR 25-500.192(5)(B) which states: "Information regarding the date and circumstance of any accident or injury shall be noted in the child's record."
On April 2, 2024, CI Eddins conducted an unannounced inspection and interviewed Director Darrah Dayson, Assistant Director Melissa Cure, Caregiver Brianna Davis, Parent B, who is also a caregiver, Caregiver Sam Jones, and Caregiver Tori Hills. Sam and Brianna stated that they observed Tori open the classroom entrance door and accidentally hit Child A in the head sometime during the morning of March 26, 2024. Sam heard Caregiver Tori refuse to write an accident report and Brianna said Tori seemed hesitant to write an accident report. They both observed a red mark on Child A's forehead and Sam observed some swelling. Tori said she did not think Child A was injured and she did not finish writing an accident report. She told Parent A about the accident at the end of the day when Parent A picked Child A up. Darrah, Melissa, and Parent B didn't know if an accident report was written.
On April 2, 2024, CI Cole Eddins observed Child A's file and did not observe any accident reports in the file.
On April 4, 2024, CI Eddins interviewed Parent A and Caregiver Freya Stewart. Parent A stated that she did not remember being notified about Child A. She also did not observe an accident report for a head injury. Freya stated that she observed a red mark and a little bump on Child A's head and that she did not observe Tori write an accident report.
