Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that on Tuesday, April 16, 2024 at approximately 4:02 PM, a teacher, Kaley Winkler, took the Child A's (age 18-months-old) hand in her hand and smacked the child's hand and then put her in a pack-n-play located within that room. This allegation is substantiated based on the following rule violation. 5 CSR 25-500.182(1)(C)7 which states: "Physical punishment including, but not limited to, spanking, slapping, shaking, biting or pulling hair shall be prohibited." On April 22, 2024, caregiver Carley Looney stated that while she was in the restroom (located inside the classroom unit), Kayley Winkeler was covering for her. She heard a loud smack and then heard Kayley say "you are not going to smack me in the face". When she came out of the bathroom, Child A (age 18-months-old), was in a pack n play screaming. She went to Jeannine Bommarito-Warren, director, and told her about what she heard. The other caregivers in the classroom unit said they saw Kayley put Child A in the pack n play aggressively. Stacey Herget, caregiver, was working on the other side of the classroom unit and did hear Kayley say "don't hit me" and then she saw her pick up Child A and put her in a pack n play. Kayley was firm in how she grabbed Child A, a little rough. Jeannine reviewed camera footage as soon as Carley told her about the incident and also showed the footage to Tanya Minto (designee). They both agreed that Kayley needed to be terminated after observing her smack Child A on the hand and aggressively put her in the pack n play. CI Graham observed video footage from April 16, 2024. Kayley Winkeler was the only caregiver in classroom. Other caregivers were on the other side of the half wall in another classroom. Child A is in a long sleeve pink shirt. -Child A is sitting on a carpet with other children. -One child is laying on the carpet beside Child A. -It is unclear what Child A does, then Kayley walks towards Child A, grabs her by the arm or wrist (unclear) and leans down towards her saying something. -Child A reaches up with her left hand and smacks Kayley in the face, knocking off her glasses. -Kayley replaces her glasses on her face. -Kayley reaches down, grabs Child A's left hand and smacks it with her hand. -Kayley then picks up Child A abruptly, under the arms, and sets her down in a pack n play. End of footage. No audio. On April 23, 2024, Kayley stated that Child A had smacked her and hit her glasses off her face. Kayley said it was just a reaction for her to smack Child A on the hand. Parent A stated that she was told about the inciden when she arrived at the facility.
