5 CSR 25-400.045 (18) The number and ages of children a family child care home is authorized to have in care at any one time shall be specified on the license and shall not be exceeded except as permitted within these rules.
5 CSR 25-400.105 (2)(A) A family child care home may be licensed for up to ten (10) children. The following staff/child ratios must be maintained at all times and shall not be exceeded except as permitted under these rules: 1 caregiver present, with up to 4 children, all may be under age two (2); 1 caregiver present, with 5-6 children, 3 children may be under age two (2); 1 caregiver present, with 7-10 children, 2 children may be under age two (2); 2 caregivers present, with up to 8 children, 8 children may be under age two (2); 2 caregivers present, with up to 10 children, 4 children may be under age two (2).
5 CSR 25-400.210 (5) Daily child attendance records shall be maintained and kept on file a minimum of one (1) year.
Conclusion Summary
On May 20, 2024, the Office of Childhood (OOC) received an allegation that on April 22, 2024 and May 20, 2024 at approximately 10:00 AM, Provider, Lori Cai Bakker, was caring for 12 children with 5 of the children appearing to be under 2-years-old. After conducting an investigation, Compliance Inspector (CI) Jade Stewart-Martin has found this allegation to be substantiated based on the following evidence: 5 CSR 25-400.045 (18) ., which states: "The number and ages of children a family child care home is authorized to have in care at any one time shall be specified on the license and shall not be exceeded except as permitted within these rules." AND 5 CSR 25-400.105 (2)(A)., which states: "A family child care home may be licensed for up to ten (10) children. The following staff/child ratios must be maintained at all times and shall not be exceeded except as permitted under these rules: 1 caregiver present, with up to 4 children, all may be under age two (2); 1 caregiver present, with 5-6 children, 3 children may be under age two (2); 1 caregiver present, with 7-10 children, 2 children may be under age two (2); 2 caregivers present, with up to 8 children, 8 children may be under age two (2); 2 caregivers present, with up to 10 children, 4 children may be under age two (2)." AND 5 CSR 25-400.210 (5) ., which states: "Daily child attendance records shall be maintained and kept on file a minimum of one (1) year." On May 28, 2024, Compliance Inspector (CI) Jade Stewart-Martin conducted an unannounced inspection and interviewed provider Lori Bakker. Ms. Bakker stated that on April 22, 2024, and May 20, 2024, that she might have had twelve children in attendance. She stated that on these dates parents could have dropped off additional kids. She has two college-aged children that live in her home. Her husband, David Bakker, is her assistant. She stated she had no attendance records for April 22, 2024, or May 20, 2024. On May 28, 2024, CI Stewart-Martin observed provider Lori Bakker and David Bakker present with two children aged 9-months old, one child aged 11-months-old, one child aged 23-months-old, three children aged 2-years-old, and two children aged 3-years-old. On June 11, 2024, CI Stewart-Martin conducted a phone interview with Emanuel McCarrell. Mr. McCarrell stated he was at Lori Bakker's residence for her annual sanitation inspection on April 22, 2024, and he counted twelve children in attendance. Lori Bakker was the only individual present in the home. On a return inspection on May 20, 2024, Mr. McCarrell observed Lori Bakker present with twelve children. During this inspection Lori Bakker was present, as well as a college-aged son, who was on a floor where childcare was not being provided. During his inspection he stated it appeared that five of the twelve children appeared to be under the age of two-years-old.
