On June 5, 2024, the Office of Childhood (OOC) received a complaint alleging that Child A ran into another student and her eye is red and swollen. When Child A's parent arrived to pick her up, her teachers were gone and there was no incident report or explanation as to what happened. The front desk assistant told Child A's parent what happened but she wasn't exactly sure herself as she was not in the classroom. Compliance Inspector (CI) Radney conducted an investigation of the allegation and found it to be substantiated based on the following information:
5 CSR 25-500.192(5)(A) - In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions.
On June 7, 2024, CI Radney conducted interviews with June McDaniel, Ashley Garrett, Barbara Hill and Nathanael Walsh. Barbara reported Ashley brought Child A in to her class in the morning, she immediately noticed a knot in Child A's eyebrow but it was not red. The class was hopping to the playground in their line and Child A came running to her crying and holding her eye. Child A's eyebrow was red and swollen. She got a new ice pack for Child A and helped Child A calm down. She was getting ready to clock out and leave and told Nathanael to fill out the incident report and she left. Nathanael reported he did not write an incident report and he did not notify Parent A. Barbara reported when she returned that day she saw Child A's injury was not worse but it was still noticeable. June's statement was consistent with Barbara and Nathanael's statements. Ashley reported Parent A picked Child A up at 5;30 p.m. and Child A had a little swollen bump around her eye but it was not red. Parent A asked what happened and she told Parent A that Child A had bumped heads with another child at recess.
On June 7, 2024, CI Radney received and observed the Active Supervision Log. Child A was signed in at 8:44 a.m. The class transitioned to outside time at 9:20 a.m. The class transitioned inside at 10:08 a.m. Child A was picked up at 5:30 p.m.
On July 12, 2024, CI Radney conducted an interview with Parent A. She was the director at the daycare when the incident occurred so all the staff had her phone number to reach her. When she dropped Child A off on June 4, 2024, there were no marks on her. She picked Child A up about 5:20-5:30 p.m. and she was with Nathanael and he didn't say anything about her bumping her head. She noticed the injury on Child A's eye before they left and asked the lady at the front desk what happened and she said she thinks she bumped into another child and that they gave her an ice pack but she didn't have an incident report or anything.
Based on the information provided, Child A was injured when she bumped into another child's head at approximately 9:20 a.m. and Parent A was not notified until approximately 5:30 p.m. when she arrived to pick Child A up.
