On June 27, 2024, the Office of Childhood (OOC) received a report alleging that the reporter was notified that children have been throwing chairs, tables, food, toys, etc. at reporter's child and others and nothing is being done about it. The children are not being sent home or anything for these behaviors which are harming other children. Compliance Inspector (CI) Heather Radney conducted an investigation of the allegations and found them to be substantiated based on the following information:
5 CSR 25-500.182(1)(C)11. - Children shall not be permitted to intimidate or harm others, harm themselves, or destroy property.
On July 3, 2024, CI Radney conducted interviews with Misty Johnson, Lara Denney, Miroslava Cantu, Megan Beeson and Erica Hudson. On August 21, 2024, CI Radney conducted an interview with Parent E, who is also a caregiver. Lara reported they are doing behavior reports often for three different children. They write incident reports and send children home for their behaviors. One child is sent home almost daily for hitting children and teachers, head butting teachers and kicking. Another child is sent home about twice a week for hitting, kicking and throwing toys. A third child is sent home about once a week for hitting, kicking, screaming and throwing toys. The other children in the room move away from them, cover their ears when there is screaming and generally try to avoid them during the day. She would say the other children are fearful of these three children due to their behaviors. Miroslava reported staff try to intervene to prevent children from intimidating or hurting others but sometimes it still happens. There are a few children in the preschool classroom that consistently hurt others. Megan reported there are three children specifically in the preschool classroom that have behaviors that are hard to control. They hit, kick, scream and throw things. Parent E, who is also a caregiver, reported she has three children in her class who are consistently hurting others. They are throwing toys, cussing, punching teachers and kids, screaming, and kicking teachers and kids. The whole class is terrified of one particular child because he throws chairs and punches kids. She tries to intervene but isn't always able to. They write up the behaviors and per their policy, they should be sent home but that doesn't always happen.
On August 29, 2024, CI Radney received and reviewed incident reports from Giggles-N-Grace Preschool LLC. Child A had incident reports dated June 11, 2024, July 9, 2024, July 10, 2024, July 16, 2024, July 18, 2024, July 19, 2024, July 31, 2024, August 7, 2024, August 9, 2024, August 13, 2024, August 14, 2024, August 21, 2024, and August 23, 2024. Child A was documented to punch, bite, throw toys, push, kick, hit, scratch, spit, slap and pinch other children and teachers. Child A was documented to break property. Child B had incident reports dated July 5, 2024, July 16, 2024, July 19, 2024 and July 23, 2024. Child B was documented to break property, throw toys and chairs. Child B was documented to hit/kick a teacher four times. Child D had incident reports dated June 3, 2024, June 13, 2024, June 28, 2024, July 5, 2024 and July 29, 2024. Child D was documented to throw chairs four times. Child D was documented to hit/kick a teacher twice, punch a child, slap a child twice and push a child. Child C had incident reports dated June 7, 2024, July 29, 2024, July 31, 2024, August 7, 2024, August 9, 2024 and August 13, 2024. Child C was documented to try to break property and throw toys. Child C was documented to punch a child, grab and scratch a child, pinch a child, hit children, hit/kick a child and hit/kick teachers.
On October 10, 2024, CI Radney conducted interviews with Parent A, Parent B and Parent C. Parent A, Parent B and Parent C reported the facility did not attempt any behavior plans or assist in ideas to help the children's behaviors. The facility would call them to come pick up their children due to their behaviors.
