5 CSR 25-500.102(2)(A)2.	Center directors and group child care home providers routinely shall be on duty during the hours of highest attendance a minimum of forty (40) hours per week. If the facility operates less than forty (40) hours per week, the center director or group child care home provider shall be on duty at least fifty percent (50%) of the operating hours.

Conclusion Summary
On July 8, 2024 the Office of Childhood (OOC) received a report alleging "Reporter has tried calling and made stops by to ask about enrolling a child and the director is never in. Staff openly admitted she is never at the facility even when she's supposed to be. They could not tell the reporter when she would be in, and they couldn't give the reporter any details about enrollment or how many kids they had." After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found this allegation to be substantiated based on the following evidence and rule violation: 5 CSR 25-500.102(2)(A)2 which states "Center directors and group child care home providers routinely shall be on duty during the hours of highest attendance a minimum of forty (40) hours per week. If the facility operates less than forty (40) hours per week, the center director or group child care home provider shall be on duty at least fifty percent (50%) of the operating hours." On July 12, 2024 CI Caylin Mertz conducted an unannounced inspection and walkthrough at the facility. CI Mertz interviewed Provider April Thomas and Caregiver Macy Parsons. Provider April indicated she is not present 40 hours per week. She stated she stops by the facility weekly but is primarily at a different facility. Caregiver Macy indicated April is not present 40 hours per week.
