5 CSR 25-400.095 (1)(B)1.D. All bedding shall be clean with sheets laundered at least once a week. Once bedding has been used by a child, it shall not be used by another child until it has been laundered.
5 CSR 25-400.095 (2)(A)1. Play equipment and materials shall be clean, in good condition with all parts intact and accessible to children.
5 CSR 25-400.085 (2)(A)9. The home shall be clean at all times and free of dirt, insects, spiders, rodents or other pests.
5 CSR 25-400.175 (1)(A)1. Child care providers shall not leave any child without competent adult supervision.
5 CSR 25-400.175 (1)(A)3. Caregivers shall provide frequent, direct contact so children are not routinely left unobserved on the premises.
5 CSR 25-400.175 (1)(A)5. Caregivers shall check on the children frequently during napping or sleeping and shall remain in close enough proximity to the children to be able to hear them if they have difficulty during napping or when they awaken. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping.
5 CSR 25-400.175 (1)(D)1. Infants and toddlers shall have constant care and supervision.
Conclusion Summary
On July 11, 2024 the Office of Childhood (OOC) received a report alleging "There is an odor in the home, and the toys have a dirt build up on them. The counters and tables are full of stuff and nasty. Toys are not put away, and rooms are just full of toys." After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found this allegation to be substantiated based on the following evidence and rule violations: 5 CSR 25-400.085 (2)(A)9 which states "The home shall be clean at all times and free of dirt, insects, spiders, rodents or other pests." On July 12, 2024 CI Caylin Mertz conducted an unannounced inspection and walkthrough at the facility. CI Mertz observed the infant room to be cluttered with less than one yard of walking space between the piles of cots, infant/toddler toys, and storage tubs. CI Mertz observed the air return in the living area to dusty and dirty. The baseboard below the air return was painted white but was observed to be brown as it was covered with dust and debris. CI Mertz observed walls throughout the facility to be stained or soiled. The exterior wall in the large play room had many stains. CI Mertz observed the white shelving in the large play room to be black on several edges which appears to be dirt and debris buildup. She stated she was not aware all of the stacked up items in the infant/toddler room were a problem. AND 5 CSR 25-400.095 (1)(B)1.D which states "All bedding shall be clean with sheets laundered at least once a week. Once bedding has been used by a child, it shall not be used by another child until it has been laundered." AND 5 CSR 25-400.095 (2)(A)1 which states "Play equipment and materials shall be clean, in good condition with all parts intact and accessible to children." On July 12, 2024 CI Mertz conducted an unannounced inspection and walkthrough at the facility. CI Mertz observed multiple stains on both pack and plays located in the infant room. The sheets on the pack and play mattresses appeared to be stained or soiled. CI Mertz observed a build up of dirt on many of the hard plastic toys in the large play room. CI Mertz observed multiple children's rocking chairs to be stained or dirty. CI Mertz observed a yellow bean bag in the living room area to have many brown stains of varying sizes. Provider Kelly indicated the dirt comes in with the children and just settles on the toys.
