Compliance Inspector (CI) Jessica Graham investigated the allegation that on July 16, 2024, Child A (age 17-months-old) was left on the playground unattended for approximately 4 minutes. This allegation is substantiated based on the following rule violation.
5 CSR 25-500.182(1)(A)1., which states: "Caregivers shall not leave any child without competent supervision."
On July 23, 2024 caregivers Kayleigh Reed and Trinity Malone said that they were in charge of Room E (including Child A) and at the time of bringing the children inside the building from the playground, the children were miscounted, resulting in Child A being left unsupervised outside. Kayleigh feels like she counted one child twice due to two children having similar outfits. Trinity only counted the three children she was in charge of and left Kayleigh on the playground with the children she would be bringing inside. Neither caregiver realized that Child A was not with them when going back into the classroom.
Hayley Hall, director, said that Angelica Vargas, caregiver, called the office because she found Child A outside on the playground without any caregivers. Hayley reviewed video footage and noticed that Child A was left outside for about 4 minutes. When Hayley returned Child A to her classroom, none of the caregivers realized she was missing. Since the incident, a training on active supervision has been completed with all caregivers.
On July 25, 2024, Angelica Vargas, caregiver, said she was in her classroom changing a child and noticed that Child A was outside on the playground alone. She went out to get Child A and called the director to let her know what happened.
On July 23, 2024, CI Graham observed video footage dated July 16, 2024. The Video 1 is of Room F. Lindsey Crouch, caregiver, is in the classroom with one child. The other children are caregivers are outside.

10:51:03 Angelica opens the door and tells Lindsey that Child A is outside by herself.
10:51:07 Angelica calls Child A over the her classroom door and then goes out to get her.
10:51:26 Angelica enters the classroom carrying Child A.
10:51:41 Angelica calls director Hayley Hall and tells her that Child A was outside by herself.
10:52:24 Hayley enters Room F and talks with Angelica, then takes Child A.
10:52:58 Belen San Miguel, caregiver, enters the room.
10:53:10 Hayley leaves the room with Child A; Belen follows.

Video 3 shows the playground. The video starts at 10:45:00
