5 CSR 25-500.182(1)(C)7. Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited.
5 CSR 25-500.192(5)(A) In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions.
Conclusion Summary
On July 30, 2024, the Office of Childhood (OOC) received a report alleging that Caregiver Addison Dyer pulled Child A (5 years old) out from under a table by his legs, causing a rug burn on the child's shoulder. Ms. Dyer did not inform the director or the parents. After conducting the investigation, Compliance Inspector (CI) Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.182(1)(C)3. which states: "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions." and 5 CSR 25-500.182(1)(C)7. which states: "Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited." On August 2, 2024, CI Eddins conducted an unannounced inspection and interviewed Board President Camille Sullentrup, Caregiver Carol Houser, and Child A. Camille Sullentrup stated that on July 29, 2024 at around 3:55 p.m., Caregiver Addison Dyer pulled Child A by his ankles out from underneath a table, which caused a rug burn on Child A's upper left shoulder. Addison admitted to her that she dragged Child A because Child A was not listening. Carol Houser stated that she heard that Child A was dragged out from under a table because Child A was not following directions. Child A stated that he did not like Ms. Addy (Addison Dyer) and that she hurt his shoulder. He was not listening, and Ms. Addy dragged him out from under a table and hurt his shoulder. CI Eddins observed small rub burn on his shoulder. On September 5, 2024, CI Eddins interviewed Parent A, who stated that she observed a band-aid on Child A's upper left arm when she returned home from daycare. Child A told her that he was not listening, and that Ms. Dyer (Addison Dyer) had grabbed his leg and pulled him out from under the table. Child A told her that he scraped his shoulder when he was pulled out from under the table. On September 5, 2024, September 10, 2024, and September 11, 2024, CI Eddins attempted to interview Addison Dyer. CI Eddins left messages and received no return phone calls. AND 5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." On August 2, 2024, CI Eddins conducted an unannounced inspection and interviewed Board President Camille Sullentrup, who stated that on July 29, 2024 at around 3:55 p.m., Caregiver Addison Dyer pulled Child A by his ankles out from underneath a table, which caused a rug burn on Child A's upper left shoulder. Addison Dyer did not notify management or Parent A of the injury on July 29, 2024. Parent A was not notified of the incident on July 29, 2024. On September 5, 2024, CI Eddins interviewed Parent A, who stated that nobody from the daycare had let her know that Child A was injured on July 29, 2024. On September 5, 2024, September 10, 2024, and September 11, 2024, CI Eddins attempted to interview Addison Dyer. CI Eddins left messages and received no return phone calls.
