5 CSR 25-500.092(1)(B)2.I. Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time.
Conclusion Summary
On August 6, 2024, The Office of Childhood (OOC) received a report alleging that infants are sleeping in bouncers, swings, and boppy pillows on the floor. Compliance Inspector (CI) JD Greer conducted an unannounced investigation and found the allegation to be substantiated based on the following information: 5 CSR 25-500.092(1)(B)2.A. which states, "An individually assigned crib, portable crib, or playpen shall be provided and used for each infant and toddler. Stack cribs shall not be used." AND 5 CSR 25-500.092(1)(B)2. I. which states, "Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time." On August 6, 2024, CI Greer conducted an unannounced walkthrough of the facility and observed Caregiver Presley Bergman was present with three children: Child A (6 months old), Child B (6 months old), and Child C (8 months old). Child A was asleep on the floor on a boppy pillow. On August 6, 2024, CI Greer interviewed Caregiver Abby Robb, Caregiver Ashley Libich, Caregiver Haley Vessar, Caregiver Jaymie Foley, and Caregiver Presley Bergman. Caregiver Abby stated she saw Child A sleeping on the floor in the infant room today, August 6, 2024. Caregiver Ashley stated today she saw Child A, Child B, and Child C sleeping, and they were not moved to cribs. Child A was on a boppy pillow and Child B was in a bouncy seat. She cannot recall if Child C was asleep on the floor or in a bouncy seat. Caregiver Hayley stated yesterday, August 5, 2024, she was working in the infant room. She let Child A sleep on a boppy pillow on the ground for approximately 30 minutes to one hour. She let Child B sleep in the bouncy seat for approximately one hour. Caregiver Jaymie stated on August 5, 2024, she was in the infant room. She allowed Child A to sleep on the boppy pillow and Child B to sleep in the bouncy seat. She does not recall how long it was for. She did not move the children once they had fallen asleep. CI Greer interviewed Caregiver Presley, who stated today, August 6, 2024, Child A fell asleep on the boppy pillow, and she did not move Child A. Child A was asleep for approximately one hour. Child B slept in the bouncy seat for approximately one hour. She should have moved Child A and Child B when they fell asleep, but she did not. On August 6, 2024, CI Greer attempted to contact Parent A (Parent of Child A), Parent B (Parent of Child B), and Parent C (Parent of Child C). CI Greer left messages and did not receive return calls. On August 19, 2024, CI Greer attempted to contact Parent A (Parent of Child A), Parent B (Parent of Child B), and Parent C (Parent of Child C). CI Greer left messagea and did not receive return calls.
