5 CSR 25-500.182(2)(C)3. Supervised "tummy time" for children under one (1) year of age to promote healthy development;
5 CSR 25-500.092(1)(B)2.A. An individually assigned crib, portable crib, or playpen shall be provided and used for each infant and toddler. Stack cribs shall not be used.
5 CSR 25-500.092(1)(B)2.I. Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time.
5 CSR 25-500.202(1)(B) The required meal schedule shall include breakfast or a midmorning snack, lunch and a midafternoon snack for children in care during daytime hours, with a maximum time of four (4) hours between any meal or snack. School-age children shall be served a snack after school.
5 CSR 25-500.087(2)(F) Child care staff shall conduct at least one (1) fire drill each month and a disaster drill at least every three (3) months. The disaster drills shall include tornado drills. The provider shall maintain a written record at the facility of the date, type of drill, time required to evacuate the building, and number of children present during the drill.
Conclusion Summary
On August 8, 2024, the Office of Childhood (OOC) received a report alleging that there was an infant who was doing tummy time. He fell asleep, and they left him asleep on the floor. The reporter observed this on August 7, 2024, at approximately 3:00 p.m. Teachers in the room at time were Sylvia and another unknown staff member. After conducting the investigation, Compliance Inspector (CI) Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.092(1)(B)2.A. which states: "An individually assigned crib, portable crib, or playpen shall be provided and used for each infant and toddler. Stack cribs shall not be used." AND 5 CSR 25-500.092(1)(B)2.I. which states: "Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time." AND 5 CSR 25-500.182(2)(C) which states: "Daily activities for infants and toddlers shall include: 3. Supervised "tummy time" for children under one (1) year of age to promote healthy development." On August 13, 2024, CI Eddins conducted an unannounced inspection and interviewed Caregiver Silvia Gibson, Caregiver Juliessa Bosley, Regional Director Brooke Rogers, Operations Specialist Shannon Ponzar, and Assistant Director Shanay Smith. Silvia Gibson and Juliessa Bosley provided consistent information. They stated they were caring for Child A on August 7, 2024 and that Child A had fallen asleep on the floor for around five to 10 minutes during tummy time. They stated that Parent A arrived to pick up Child A and he observed Child A asleep on the floor. Neither caregiver was near Child A when he was doing tummy time and fell asleep. Brooke Rogers, Shannon Ponzar, and Shanay Smith stated that they heard that Child A had fallen asleep for an unknown amount of time on August 7, 2024. Child A fell asleep on a boppy pillow. On August 14, 2024, CI Eddins interviewed Parent A. Parent A stated that he had observed Child A sleeping face down with his eyes closed on a boppy pillow on the floor. He did not know how long Child A was sleeping on August 7, 2024. On September 18, 2024, CI Eddins interviewed Reporter Gloria Leyva, who stated that on August 7, 2024, she observed Child A asleep on a boppy pillow on the floor with no caregivers around him.
