On October 15, 2024 the Office of Childhood (OOC) received a report alleging "The director is not at the facility 40 hours per week." After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found this allegation to be substantiated based on the following evidence and rule violation:
5 CSR 25-500.102(2)(A)2 which states "Center directors and group child care home providers routinely shall be on duty during the hours of highest attendance a minimum of forty (40) hours per week. If the facility operates less than forty (40) hours per week, the center director or group child care home provider shall be on duty at least fifty percent (50%) of the operating hours."
On October 18, 2024 CI Caylin Mertz conducted an unannounced inspection and walkthrough at the facility. Over the course of the investigation, CI Mertz interviewed Director Michelle "Shelli" Webb, Caregiver Lacy Brown, Caregiver Joanna Murcado and Caregiver Jessica Blankenship. Director Shelli indicated she does not track her attendance. Lacy, Joanna and Jessica all indicated Shelli is not present for 40 hours a week and is there for roughly 30 to 35 hours total.
5 CSR 25-500.222(6) which states "Daily staff and volunteer attendance records shall be maintained and kept on file a minimum of one (1) year."
On November 5, 2024, Director Michelle Webb indicated she does not track her attendance at the facility.
