5 CSR 25-400.105 (1)(B) The provider shall name an assistant caregiver who shall be available to substitute during his/her absence or to meet staff/child ratios.

Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that Parent A stated that the providers mother is left alone with the children and she is not sure if she is approved to do so. This allegation is substantiated based on the following rule violations: 5 CSR 25-400.105(1)(B) which states: "The provider shall name an assistant caregiver who shall be available to substitute during his/her absence or to meet staff/child ratios." AND 5 CSR 25-600.020(1) which states: "Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department." On November 4, 2024, caregiver Jamika Allen stated that her mom was left with the children for a short time while she stepped out. Her mother is not an approved assistant but she does have an approved assistant that she can use. Parent A said that when she picked up Child A from Jamika she was told that Jamika's mom had been caring for Child A that day for awhile. On November 4, 2024, CI Graham observed a text message between Parent A and Jamika Allen, caregiver. Parent a was texting Jamika to see if Child A had drank his milk. Jamika responded: "My mom with him now I'm ask her when I get back. I took the other two to the library." This message was sent at 9:59am. 5 CSR 25-400.210 (2) ., which states: "An individual file shall be kept to identify each child and to enable the provider to communicate with the parent(s), guardian, or legal custodian of the child in an emergency. Records shall include:" Child A did not have an enrollment form on file but is no longer attending the facility.

The facility shall notify all caregivers (paid employees and paid or unpaid volunteers) of the violations which were substantiated and specify the actions to be taken by all caregivers, in order to comply with all violations cited.
