On December 17, 2024, the Office of Childhood (OOC) received a report alleging that a member of the daycare staff administered seizure medication without proper consent. No phone call had been made to Child's father or mother before the medication was administered. Child A was given a full dosage of this medication when the instructions were to only give them half. After conducting the investigation, Compliance Inspector (CI) Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.192(3)(B) which states: "All medication shall be given to a child only with the dated, written permission of the parent(s) stating the length of time medication may be given."
and
5 CSR 25-500.102(1)(F) which states: "Caregivers shall be capable of handling emergencies promptly and intelligently."
On December 18, 2024, CI Eddins interviewed Parent B (Parent of Child A), who stated that he heard that on December 16, 2024 at around 10:00 a.m., Child A received a double dosage of Child A's seizure medication (Clonazepam) by accident. Child A was only supposed to receive a half pill of Clonazepam after a seizure was observed, but Child A was accidentally given the full pill before a seizure took place. Child A was rushed to the emergency room after Parent A discovered Child A was given the wrong amount of Clonazepam. Caregiver Claire Duncan was the caregiver responsible for giving Child A her double dose of Clonazepam. He heard that Child A was showing symptoms of an upcoming seizure, and Claire had possibly panicked and gave Child A the full dose of Clonazepam by accident.
On December 18, 2024, CI Eddins conducted an unannounced inspection and interviewed Director Michelle Mannell, Caregiver Katelyn Heckeroth, Caregiver Claire Duncan, Administrative Assistant Maya Nichols, Assistant Director Tonya Hunsaker-Ferris, and Parent A (Parent of Child A). All staff members provided consistent information. They stated that on December 16, 2024, Child A appeared lethargic, groggy, and unresponsive. Claire, in her panicked state of mind, had accidentally given Child A a full pill of Clonazepam before Child A's seizure had ever started. Child A was only supposed to receive a half dose of Clonazepam after a seizure was observed. After hearing that Child A received a full dose of Clonazepam, Parent A immediately rushed Child A to the emergency room.
On December 18, 2024, CI Eddins conducted a walkthrough of the facility and observed Child A's medication authorization form, which states that Child A should receive half a tablet during a seizure lasting over five minutes. Her medication authorization form does not specify who has to give the medication but that the medication can be given in general. The incident on December 16, 2024, was also recorded with a full tablet dosage.
