Compliance Inspector (CI) Jessica Graham investigated the allegation that there are three felons working in the program. The facility hires people without running background checks. This allegation is substantiated based on the following rule violations.
5 CSR 25-600.020 (5) which states: "Criminal background checks shall be completed for each child care staff member every five (5) years."
On March 10, 2025, Karen Whitener, managing member, and Kelly Cureton, director, said that background screenings are ran on all caregivers prior to them being employed. They were not aware that some of the criminal background checks were expired for some caregivers but will get those updated.
On March 10, 2025, CI Graham reviewed all caregiver files and the following was documented:
Kylie Bothyl: needs criminal background screening and facility orientation
Toni Wheeling: needs criminal background screening and medical
Abbigael Crowder: needs criminal background screening and facility orientation
Karen Whitener: needs criminal background screening
Kelly Cureton: needs criminal background screening
Mallorie Miller: needs facility orientation
5 CSR 25-500.102(1)(K) which states: "The child care provider shall ensure that within seven (7) days of employment or volunteering, and before being left alone with children, that caregivers employed on or after August 30, 2019, receive a facility orientation."
AND
5 CSR 25-500.122(1)(A) which states: "All persons working in a child care facility in any capacity during child care hours, including volunteers counted in staff/child ratios, shall be in good physical and emotional health with no physical or mental conditions which would interfere with child care responsibilities. These persons shall have a medical examination report, signed by a licensed physician or registered nurse who is under the supervision of a licensed physician, on file at the facility at the time of initial licensure or within thirty (30) days following employment."
In addition to missing criminal background screenings, CI Graham determined that Kaylie Bothyl and Mallorie Miller need did not have facility orientations completed within their seven day hire date and Toni Wheeling did not have medical examination report within 30 days of her hire date.
