On April 1, 2025, the Office of Childhood (OOC) received a complaint alleging that Child A has epilepsy. Staff said they did not know that Child A had epilepsy. Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation and found it to be substantiated based on the following information:
5 CSR 25-500.122(2)(D) - The parent(s) of a school-age child shall provide a report at the time of enrollment indicating the child's health history, any current health problems, and any restrictions necessary for the child's care.
AND
5 CSR 25-500.102(1)(E) - Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care.
On April 7, 2025, CI Radney conducted interviews with Jessie Terry and Sophia Mathis. Caregivers reported they did not know Child A had a seizure disorder until Parent A told them in person on March 31, 2025. Caregivers reported Child A's enrollment form is not at the facility.
On April 28, 2025, CI Radney conducted an interview with Tonya Walker. She was not aware that Child A had a seizure disorder. The director that is on site should have caught the discrepancy that the parent noted he was in good health on his enrollment form but also noted that he has epilepsy medication.
On April 28, 2025, CI Radney received and reviewed Child A's enrollment form. The child is school-aged, participating in a school-age program. On the Child Health Questionnaire, the parent indicated "My child is in good health, is able to participate in group care, has no special needs, health or medical requirements." On Child Health or Medical Requirements, the parent wrote "Epilepsy medication." The child's enrollment date is listed as August 21, 2024.
Based on the information provided by Ozarks Regional YMCA staff, nobody noticed the discrepancy on Child A's enrollment form where the parent indicated the child was in good health with no special needs but also listed epilepsy medication as a medical requirement. Caregivers were unaware of Child A's seizure disorder from the time of enrollment, August 21, 2024 until Parent A told them in person on March 31, 2025. Caregivers did not have knowledge of the child's needs when they did not request the parent to provide additional or clarifying documentation based on the information provided on the enrollment form, which indicated Child A has epilepsy medication.
