Compliance Inspector (CI) Jessica Graham investigated the allegation that Child A (age 3-years-old) came home from daycare with a red mark on her forehead that hurt when pressed on. She also had scrapes on her elbows and knees. Parent A asked the daycare what had happened and was told there had been an "incident." No further explanation was provided. 5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
On April 28, 2025, Parent A said that she arrived to pick up Child A from the facility and Child A showed her an injury on her knee. She was not told about the injury prior to pick up. Once getting home she saw other marks on Child A. Child A has a language disorder and is not verbal enough to say what happened.
On April 30, 2025, Ashley Parker, director, said she was made aware of Child A's accident to her knee when she arrived back at the center. Parent A was asked to sign an incident report when she picked up Child A but she refused. She thinks the accident happened right before Parent A arrived.
Tatiana Hernandez, caregiver, said she was not present when Child A got hurt but Ashley had asked her to sign the accident report today, even though she did not witness it.
Emily Salas, caregiver, was outside when Child A got hurt. Child A was running and she slipped over a bike and hurt her knee. She checked her and she was okay. Then Child A was swinging and she fell and hurt her elbow. She put a band aid on it and wrote an accident report. Parent A arrived at pick up and she told her about the incident.
On April 30, 2025, Compliance Inspector (CI) Jessica Graham observed the accident report for Child A. It was dated 4-24-2025 with a time of 3:24pm. The report listed Emily Salas and Ashley\ Parker in charge and responsible for Child A during that time. Jasmine Russel was listed as another caregiver present. The report was signed by Tatiana Hernanez. The report stated:
"She fell off the swing and hurt her arm she has scratch on her elbow right elbow" "I hurried up and checked her to make sure she is okay and put a bandade on her"
This report did not mention Child A hurting her knee from the bike nor was there another report for that injury. There was no method of contact listed for parent notification to show that the parent was contacted immediately.
