On May 12, 2025, the Office of Childhood (OOC) received a report alleging there was an incident where Child A had multiple scratches on his neck, face, and arms. Grandparent A was not called about this incident. Compliance Inspector (CI) JD Greer conducted an unannounced investigation, and found the allegation is substantiated based on the following information:
5 CSR 25-500.192(5)(A) which states, "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions. "
On May 15, 2025, Compliance Inspector (CI) JD Greer interviewed Teacher Gabriela "Gabby" Jones, Teacher Ashton Morrow, and Assistant Director Shanay Smith. Gabby stated she was present on May 7, 2025, when Child A (2 years old) was scratched in the face. Child A and another child were not getting along and the other child scratched Child A in the face. Gabby completed an incident report immediately and gave it to Assistant Director Shanay Smith to notify Grandparent A. Gabby is unsure if Grandparent A was notified of the scratches because she was told the administrative team will notify the parent/guardian of accidents or injuries. Ashton stated she was present with Gabby and Child A on May 7, 2025. It is her understanding that Director Justin Burmeister or Assistant Director Shanay Smith will notify the parent of accidents and injuries. She recalls Gabby writing an incident report right away and giving it to Shanay. She does not know if Shanay contacted the parent/guardian. Shanay stated she was in charge of the facility on May 7, 2025. She did not notify Grandparent A when Child A's face was scratched.
The facility was also found to be in violation of the following licensing rule:
5 CSR 25-500.192(5)(B) which states "Information regarding the date and circumstance of any accident or injury shall be noted in the child's record."
On May 15, 2025, Compliance Inspector (CI) JD Greer interviewed Director Justin Burmeister, who stated an incident report was filled out, but it is believed Grandparent A took the report home. They do not have a copy of the incident report on file at this time.
