Conclusion Summary
On May 15, 2025, the Office of Childhood (OOC) received a report alleging that there have been several age groups interacting on the playground, and there have been accidents reported. These children range in age from infancy to school-age. One of these accidents involved an infant being struck by a moving swing. Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation and found it to be substantiated based on the following information: 5 CSR 25-500.082(6)(B)1. - Outdoor play space for infants and toddlers shall be separate from that used for older children or the same space shall be used at different times. (This rule does not apply to group day care homes with a maximum of four (4) infant/toddlers or to day care centers licensed for a maximum of twenty (20) children, including no more than four (4) infant/toddlers.) On May 20, 2025, CI Radney conducted interviews with Jeanine Blankenship, Stella Humphrey and Trisha Wilson. Caregivers reported the allegation is true. Child A, who is 18 months old, was in the big playground with school-agers when she was accidentally hit by a swing. The caregiver would bring Child A over to the big playground when she was the last infant/toddler left in class so she could be with other children.
