5 CSR 25-500.182(1)(C)7. Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited.
5 CSR 25-500.182(1)(C)8. No discipline technique which is humiliating, threatening, or frightening to children shall be used. Children shall not be shamed, ridiculed, or spoken to harshly, abusively, or with profanity.
Conclusion Summary
On June 5, 2025, the Office of Childhood (OOC) received a complaint alleging that Bailey Jacobs is verbally rough on students, to the point they cry and are scared to come into school. This teacher only has about four kids she is nice to, and she screams at the other kids daily. She has been heard by other teachers as well as parents throughout the day during pick up and drop off. She has told students they are dumb, and they won't ever be a "big girl" because she is not potty trained. Bailey is now getting to the point where she grabs the students and it is rather rough physically. When Bailey grabs a kid, you can see the anger in her face. Reporter, even as an adult, would have been scared. Bailey singles kids out and will not let a kid interact with the class just because she does not like that student. She told this little girl that she was "too stupid to paint". Compliance Inspector (CI) Heather Radney conducted an investigation and found the allegations to be substantiated based on the following information: 5 CSR 25-500.182(1)(C)3. - Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions. AND 5 CSR 25-500.182(1)(C)8. - No discipline technique which is humiliating, threatening, or frightening to children shall be used. Children shall not be shamed, ridiculed, or spoken to harshly, abusively, or with profanity. On June 5, 2025, CI Radney conducted interviews with LLC Member Baily Austin, and Caregivers Halee Gary, Tammy Hardiman, and Pamela Cook. Baily Austin reported Bailey Jacob is stern with her tone, and they've discussed that with her before. Halee Gary reported Bailey J. is verbally rough with the kids. It is alarming to her the way that Bailey J. speaks to kids. She's heard Bailey J. say things about children within earshot like "they're too stupid to paint". She's heard Bailey J. say things to children directly like "You're never going to be a big girl or be able to do big girl things because you're not potty trained." Bailey J. is very loud; you can hear her throughout the building. Sometimes children jump or cry when Bailey J. gets loud. Bailey J. does speak harshly to children. She's heard Bailey J. say a child is "stupid" in front of the child. Tammy Hardiman reported Bailey J. is loud and aggressive with the children. Bailey J. has held Child B down at nap. Bailey J. held her down on the cot using her arms on the child's arms and legs, while sitting next to her saying "you need to lay down." Child B is usually kicking and screaming and saying thinks like "Stop" or "You are hurting me" or "I want Halee." Other classrooms can hear Bailey J. because she is so loud. She's jumped before when Bailey J. has been loud, and it startled her. Children have jumped before when Bailey J. has been loud. The kids are scared of Bailey J.; they ask for Halee. Children do feel intimidated, threatened or spoken harshly to by Bailey J. It is not age-appropriate or constructive. Pamela Cook reported she can hear Bailey J. yell from her room. Bailey J. yells things like "sit down" "you're driving me crazy" "I can't deal with you anymore." Mainly Bailey J. yells at Child A and Child B because they don't listen. Bailey J. came into her classroom one day and picked Child C up by one leg and one wrist and carried her out of the room because she didn't like that Child C was being loud during naptime. Bailey J. is aggressive with the kids verbally and physically. She's seen Bailey J. pick kids up roughly by their wrists or ankles. Child C started screaming when Bailey J. picked her up. The kids don't want to be in the room with Bailey J. Kids are spoken harshly to and in a rude manner. On July 22, 2025, CI Radney conducted an interview with Parent A. Parent A reported Child A said if she didn't do "XYZ", "Ms. Bailey was going to be super mad and she was going to be in big trouble." She personally saw Bailey snatch a kid up by his arm and pull him aggressively. The child looked concerned. She personally saw a child really upset and Bailey grabbed his arm aggressively and drug him to another room. The child was crying before and after she grabbed him. On August 11, 2025, CI Radney conducted an interview with LLC Member/Director Melody Fitch. She reported that prior to the complaint, they had had a discussion with Bailey about her tone. She was not aware of the severity of the situation until the complaint. Bailey had a rough tone. Caregiver Bailey Jacobs was not using constructive, age-appropriate methods of discipline and was using threatening or frightening discipline techniques when she was shaming and speaking harshly to the children in the class as described by caregivers and Parent A above. 5 CSR 25-500.182(1)(C)7. - Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited. On June 5, 2025, CI Radney conducted interviews with Halee Gary and Tammy Hardiman. Halee reported that she has seen Bailey J. hold children down. Bailey J. would either have a firm hand on their backs or a hand on their shoulder areas and leg areas. Children usually say things like "No" or "Stop". Tammy reported that Bailey J. has held Child B down at nap. Bailey J. held her down on the cot using her arms on the child's arms and legs, while sitting next to her saying "you need to lay down." Child B is usually kicking and screaming and saying thinks like "Stop" or "You are hurting me" or "I want Halee." Caregiver Bailey Jacobs was using physical punishment when she held children down during nap.
