Conclusion Summary
On September 4, 2025, the Office of Childhood (OOC) received a report alleging that since August 25, Child A has come home daily with black particles all over her hands, feet, clothes, in her diaper, hair, and everywhere. The floors in the daycare are peeling. It's also very dirty and dusty in there. After conducting the investigation, Compliance Inspector (CI) Curtis West finds the allegation is substantiated. This conclusion is based on the following evidence of a licensing rule violation that occurred at the facility: 5 CSR 25-500.082(2)(A)6., which states "Walls, ceilings and floors shall be finished with material which can be cleaned easily and shall be free of splinters, cracks and chipping paint. Floor covering shall be in good condition. Lead-free paint shall be used for all painted surfaces." And 5 CSR 25-500.082(2)(A)7., which states "Concrete floors in areas counted as child care space shall be covered with carpet, tile, linoleum or other floor covering." On September 4, 2025, CI West interviewed Parent A (Parent of Child A), who stated that she noticed pieces of paint from the floor in Child A's hair and on her clothes. It took a deep cleaning to get the paint pieces from the floor off Child A. On September 4, 2025, CI West received an email from Parent A. The email contained a picture of the paint that had come off the floor and was on Child A's hand. On September 5, 2025, CI West conducted a walkthrough of the facility and interviewed Director Brian Rivera, Caregiver Ruby Busumante, Caregiver Brooklyn Beyer, and Caregiver Mackenzie Mauricio. Brian stated that he only had one parent bring up concerns about the condition of the floors. He has noticed the paint is coming up from the floors more than usual. He spoke with Princess about the paint on the floors needing a touch-up. Ruby, Brooklyn, and Mackenzie provided consistent information. They stated that they had noticed that the paint on the floors had started to come off. CI West observed two rooms where the paint on the concrete floors had begun to peel.
