RSMo 210.211 (8) "Nursery school", a program operated by a person or an organization with the primary function of providing an educational program for preschool-age children for no more than four hours per day per child.
RSMo 252.1. All buildings and premises used by a child-care facility to care for more than six children except those exempted from the licensing provisions of the department of health and senior services pursuant to subdivisions (1) to (15) of subsection 1 of section 210.211, shall be inspected annually for fire and safety by the state fire marshal, the marshal's designee or officials of a local fire district and for health and sanitation by the department of health and senior services or officials of the local health department. Evidence of compliance with the inspections required by this section shall be kept on file and available to parents of children enrolling in the child-care facility.
Conclusion Summary
On March 25, 2025, the Office of Childhood (OOC) received a report alleging that there were 15 children to one teacher (Owner Sierra Fisher) on multiple occasions. After conducting the investigation, Compliance Inspector (CI) Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: RSMo 252.1. which states: "All buildings and premises used by a child-care facility to care for more than six children except those exempted from the licensing provisions of the department of health and senior services pursuant to subdivisions (1) to (15) of subsection 1 of section 210.211, shall be inspected annually for fire and safety by the state fire marshal, the marshal's designee or officials of a local fire district and for health and sanitation by the department of health and senior services or officials of the local health department. Evidence of compliance with the inspections required by this section shall be kept on file and available to parents of children enrolling in the child-care facility." On September 24, 2025, Compliance Inspector (CI) Cole Eddins attempted to conduct a walkthrough of the facility but observed zero children or providers on-site. CI Eddins called Provider Sierra Fisher. Sierra stated that she had 11 children at her daycare on the morning of September 24, 2025. On October 7, 2025, CI Eddins completed an unannounced inspection and walkthrough of the facility and observed six children. CI Eddins observed four 4-year-olds, one 3-year-old, and one 6-year-old. CI Eddins interviewed Sierra, who stated she had reduced the number of children in her car for six. On November 13, 2025, CI Eddins observed the original fire and sanitation inspection requests, which are dated November 8, 2024 and are for 10 children. CI Eddins observed an unapproved fire inspection for 10 children, dated January 14, 2025, and an approved sanitation inspection for 10 children dated June 9, 2025. CI Eddins observed the second fire and sanitation inspection requests, dated September 25, 2025, for 19 children. CI Eddins observed that the fire inspection was approved for 19 children on October 1, 2025, and the sanitation inspection was approved for 19 children on October 6. This program was approved by sanitation for only 10 children and did not have an approved fire inspection at the time the complaint was received and the investigation initiated. RSMo 210.211 (8) which states: ""Nursery school", a program operated by a person or an organization with the primary function of providing an educational program for preschool-age children for no more than four hours per day per child." On October 7, 2025, CI Eddins interviewed Sierra, who stated that she had four 4-year-olds, one 3-year-old, and one 6-year-old at her nursery school daycare. On October 7, 2025, CI Eddins completed an unannounced inspection and walkthrough of the facility and observed one 6-year-old child amongst the six total children in attendance.
