5 CSR 25-500.092(1)(B)2.I. Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time.
Conclusion Summary
On October 3, 2025, the Office of Childhood (OOC) received a complaint alleging that when Parent A showed up unannounced and not at a normal time, Child A was in the swing asleep. Parent A had a meeting with the board about how babies die from being left unattended to sleep in the swing, yet three months later, they have a new baby sleeping in the swing daily. Compliance Inspector (CI) Heather Radney conducted an investigation and found the allegation to be substantiated based on the following information: 5 CSR 25-500.092(1)(B)2.I. - Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time. On October 8, 2025, Compliance Inspector (CI) Heather Radney conducted an interview with Jessica Daily, who reported in the past, they had babies falling asleep in swings and not moved immediately. Child A was asleep in a swing, and Parent A saw. Parent A instructed staff not to allow Child A in a swing anymore. Parent A said it happened again, and she talked to administration. On November 17, 2025, CI Radney interviewed Parent A, who reported the incident occurred as described in the allegation. In October, she observed Child A sleeping in a swing and asked the classroom teachers not to allow that to happen. She talked to administration about her concern. She was told Child A would not be allowed in the swing. In February, she observed Child A asleep in the swing again and asked teachers not to allow that. On February 27, 2025, she arrived and Child A was asleep in the swing. She spoke to Bre and the swing was then removed the next day. Before she pulled Child A from the daycare for good, the swing had returned and there was another child sleeping in the swing. On November 18, 2025, CI Radney interviewed Erin Law and Breanna "Bre" Russell. Erin reported she was not working here for the swing incident where Parent A saw Child A sleeping in a swing. She started working here in May 2025. From what she has heard, they removed the swing because Child A was being put in the swing and falling asleep.,Bre reported Parent A complained to her a couple of time that she was seeing babies sleeping in swings. She met with the teachers and it was happening. She instructed them not to allow any babies to sleep in swings. It stopped for a while.
