On November 10, 2025, the Office of Childhood (OOC) received a report alleging that viewing of the video showed Tina Cabe pull a child to her cot and force her to lie down, using first her leg across the child, and then her entire body as a restraint across the child. Tina Cabe was observed striking a child repeatedly on the hand at nap time. Upon investigation and observation of video footage from the classroom camera, it was observed that Ms. Tina Cabe did repeatedly use her hand to strike the child on her hand. After conducting the investigation, Compliance Inspector (CI) Curtis West finds the allegation is substantiated. This conclusion is based on the following evidence of a licensing rule violation that occurred at the facility:
5 CSR 25-500.182(1)(C)7., which states "Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited."
And
5 CSR 25-500.182(1)(C)9., "Punishment or threat of punishment shall not be associated with food, rest, or toilet training."
On November 13, 2025, CI West conducted an unannounced inspection and interviewed Director Deborah Mann, Caregiver Patricia Bradley, Caregiver Denise Crawford, and Caregiver Tylesha Smith. Deborah and Patricia provided consistent information. They stated that Denise advised them of the need to watch the footage from November 6, 2025, in the preschool classroom. They observed Tina striking Child A on her hand. They observed Tina lie down on the cot next to Child A and use her body weight to restrain Child A on her cot. Denise stated that Tylesha requested that she review the video on November 6, 2025, because she saw Tina strike a child. She reviewed the video and saw Tina strike Child A on the hand several times. She observed Tina forcefully restrain Child A onto her cot with her body leaned against Child A. Tylesha stated that she saw Tina grab Child A by the left hand. She saw Tina use her open hand to strike Child A's hand several times. She saw Tina get down on to the cot a lay next to Child A on the cot and use her body weight to keep Child A down.
On November 13, 2025, CI West conducted a walkthrough of the facility and observed video footage taken on November 6, 2025. The camera was facing down from the corner of the ceiling. There wasn't any sound to the footage. Tina grabs a paper towel from Child A's hand. Tina forcefully places Child A on the cot and holds her down with her left foot and leg while Tina is sitting facing the cot. Tina stands up to walk around the bookshelf and lies down on the cot with Child A. Tina repositioned herself on the cot with Child A. Tina used her body weight to restrain Child A onto her cot. All of the actions cannot be seen due to glare and the child's cot being behind a bookshelf.
