5 CSR 25-500.182(1)(A)5. A caregiver shall remain in the room with preschool and school-age children while they are napping or sleeping and shall be able to see and hear them if they have difficulty during napping or when they awaken.
5 CSR 25-500.192(5)(A) In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions.
5 CSR 25-500.192(5)(B) Information regarding the date and circumstance of any accident or injury shall be noted in the child's record.
Conclusion Summary
On December 4, 2025, the Office of Childhood (OOC) received an allegation of on December 01, 2025, Child A (3-years-old), ended up with a contusion above her right eyebrow when she was alone in a classroom without any supervision. On December 8, 2025, Compliance Inspector (CI) Christy Hughes conducted an unannounced inspection of the facility and found the allegations to be substantiated based on the following information. 5 CSR 25-500.182(1)(A)1. which states: "Caregivers shall not leave any child without competent supervision." AND 5 CSR 25-500.182(1)(A)3. which states: "Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises." AND 5 CSR 25-500.182(1)(A)5. which states: "A caregiver shall remain in the room with preschool and school-age children while they are napping or sleeping and shall be able to see and hear them if they have difficulty during napping or when they awaken." On December 8, 2025, CI Hughes conducted in person interviews with director Shay White, caregivers Jodi Enloe, Kayla Burton and Erica Oldham and Child B and Child C. Shay stated that she did not see a mark on Child A, but she had her hood up while she was with her. She did not know Child A had been injured or she would have contacted the parent. There was no incident report in Child A's file. She has had to speak with Jodi once about leaving her classroom unattended but it was not documented. Jodi stated that she did not know that Child A hurt herself. Child A would cry if she was injured. She did not see a mark on the child. She does not leave her classroom unattended. Kayla stated that she does not see Jodi leave her room. She has not been trained on mandated reporting. Erica stated Child A was the last child at the center on December 1, 2025. Child A had her hood up while waiting to be picked up. She did not see the mark. Parent A called back within approximately 5 minutes about the mark asking what had happened. She has had to speak to Jodi several times about leaving her classroom unattended but never documented the conversations. Child B (age 4-years-old) stated he likes school. He did not see anyone fall. Child C (age 4-years-old) stated that Child A fell and hurt her knee. Ms. Jodi leaves and sometimes another teacher comes in the room. On December 11, 2025, CI Hughes conducted an interview via phone with Parent A. Parent A stated that she picked up Child A from the center and went home. She lives approximately 3 minutes from the center. When Parent A arrived home, she noticed a large bump above Child A's right eye. Child A told her she fell on the cot. When Parent A questioned if she told the teacher Child A told her that the teacher was not in the classroom to tell. Parent A immediately contacted the center to ask what had happened and Erica and Child A's teacher, Jodi did not know. She then contacted the director Shay, and she too did not know what had happened. Parent A stated that this is not the first time Child A has had injuries from the center that no one knew about. She said it has happened about 5-6 times. She has never received an incident report or phone call about them. She has spoken with both Shay and Erica about it. On December 11, 2025, CI Hughes observed pictures sent from Parent A of Child A's injuries. One photo is time stamped from November 19, 2025, showing a large scratch on Child A's forehead and two photos time stamped from December 1, 2025, showing a large bump above Child A's right eyebrow.
