On January 22, 2026, the Office of Childhood (OOC) received a complaint alleging on Thursday, January 22, 2026 at approximately 2:45 p.m., Child A (4 years old) is seen walking over to sit on the cot of Child B (4 years old) to look at a drawing board together. The room was darkened as children were in the process of waking up from their naps. Soon after Child A sat on the cot, both of the children pulled their pants down and were touching each other on the genitals and buttocks. They pulled their pants back up and moved next to the cot, where they pulled their pants down and touched each other's genitals and buttocks again. Then they pulled their pants up and went under a table, where they pulled their pants down and touched each other's genitals and buttocks again. During this time, the teacher in the classroom, Monic Trevino, can be seen sitting off to the side of where the incident was taking place at a table playing with a couple other children. At 3:02 p.m., Monic walks over to near where the children are and turns on the lights. Child B was under the table, and Child A told Monic that Child B was showing his bottom. Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation and found it to be substantiated based on the following information:
5 CSR 25-500.182(1)(A)3. - Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises.
On January 28, 2026, Compliance Inspector (CI) Cole Eddins completed an unannounced inspection and interviewed Director April Thomas. She first heard about the concern on January 22, 2026, at 3:22 p.m. after she received a text from Director Megan Beeson regarding the incident. She immediately skimmed through the cameras and saw Child A and Child B touching each other inappropriately for around five to 10 minutes while Caregiver Monic Trevino was supposed to be watching them. After observing the video, she observed that on Thursday January 22, 2026, at around 2:55 p.m., Child A can be seen sitting next to Child B on her cot when the incident first started. The children were just waking up and doing quiet play before Caregiver Monic Trevino turned on the lights. Monic was sitting on a table interacting with children while Child A and Child B inappropriately touched each other for around five to 10 minutes. Child A and Child B started on one of their cots, moved to under the table, and back to their cot. Child A and Child B often look over at Caregiver Monic Trevino as if they were trying to hide their actions. It is not until around 3:02 p.m. that the children stop interacting with one another and separate. Child A and Child B had inappropriately touched each other and tried to pull each other's pants down for around five to 10 minutes. Child A had a prior incident where he pulled his plants down earlier in the same week. He did not touch another child when he pulled his pants down. Monic was was sitting on a table to the left of the children. Monic was sitting on a table playing with a doll while interacting with children as nap time was wrapping up.
On January 28, 2026, CI Eddins received and reviewed a video of the incident. On Thursday January 22, 2026, at around 2:55 p.m., Child A can be observed sitting next to Child B on her cot. The children were just waking up and doing quiet play. The lights in the room were still off so it was a little hard to see. Children were doing quiet activities, playing with tablets and dolls while the other kids wake up. At 2:55:57 p.m., Child A can be observed reaching his hands in his pants and lifting his body (genitals) towards Child B. Monic is observed sitting on a table interacting with children about eight feet two inches to the left of Child A and Child B, who were still sitting on their cots at the time. Child A and Child B often look over at Caregiver Monic Trevino. Monic looked over at the children at around 2:56:40 p.m., but she did not address the children. CI Eddins observed six children in the room. April said they were 4 years old. Child A and Child B continue to mess with their pants and look at each other. Child B lays down while Child A looks over at Monic at 2:58:12 p.m. while he is still sitting near their cots on the right side of the room. Child A tries to pull on Child A's pants while looking over at Monic. Monic possibly addresses the children as they both sit up at 2:58:52 p.m. Monic looks over at Child A and Child B while they look back. Both and Child A's and Child B's pants are still on. Child A and Child B lay down and begin to play with one another. Child A and Child B go under the table on the back right side of the room at 2:59:42 p.m. Monic still has vision of the table from where she is sitting. Child A possibly pulls his pants down while facing Child B under the table. Visibility is not good so it is difficult to see exactly what is happening. Monic looks over the children at 3:00:24 p.m. Child A and Child B come out from under the table at 3:00:30 p.m., and Monic looks over at Child A and Child B again. Child A and Child B sit down next to their starting cot. Child B tries to pull Child A's pants down at 3:01:00 and is touching Child A's private area. Both children still have their pants on but it appears Child A's pants are partially lowered. Child A reaches back over to touch Child B in her private area. Monic looks over at Child A and Child B again but does not notice the interaction between the children. Child A and Child B continue to trade inappropriate touches before getting up and sitting on a couch. Monic address the two children at 3:01:32 p.m., and both children turn to face her. Child A and Child B pat each other on their bottoms before Monic gets up at around 3:02:07 p.m. Monic is walking around the classroom and Child A and Child B separate at 3:02:12 p.m.
On January 29, 2026, CI Radney conducted interviews with Director Megan Beeson, Caregiver Monic Trevino, Caregiver Shelby Robertson, Parent B (who is also a caregiver), and Child B. Megan reported Monic said Child A showed his bottom when she (Monic) "walkied" and asked her to come in there. She went in immediately, and Monic said Child B said Child A showed her his bottom and asked if she could look on the camera and see. She saw Child A pull down his pants and partially show his bottom. She went back further, and she observed more on the video. On the video, she observed the children playing with drawing boards. They kept looking back and forth at the teacher and when the teacher wasn't looking, they were trying to pull each other's pants down and pulling their own pants down. Every time the teacher would look, they would stop. Monic was to their side; she wasn't turned away from her. They were playing on the floor and would stop playing and go to pulling their pants down. Then they moved to another spot and did the same thing. When Monic was walking around, they would stop. Child A was looking to the teacher and every time she would look at them, he would stop. You can see on the video the children touching each other's privates. Their backs are to the camera but it appeared as though that is what was happening. It took longer for them to pull their pants down than them touching each other. Some of the time the touching was over the pants.
Monic reported during naptime, she saw Child A and Child B under the table, so she went over and asked why they were under the table. They didn't say anything, and she didn't notice them doing anything. She saw them together on a cot, which wouldn't be abnormal. Child A came up to her a couple times and his pants were unbuttoned and he asked her to button them. She thought they were just tight. The kids starting getting up so she turned on the light. She was putting on a child's shoes. She saw them under the table the second time right after nap time, so she asked them what they were doing and Child B said Child A had his pants pulled down. Child A said "I have to go to the bathroom. Please don't tell my mom."
Parent B reported she was here on Thursday. She learned about the incident when Megan told her that she was reviewing cameras because an incident had happened. She saw on video, both children pulled their pants down but she doesn't remember if they touched each other or not in that instance. Child B reported that she was under the table. Child A pulled his pants down and tried to show his butt.
On March 17, 2026, Compliance Inspection Supervisor (CIS) Romena Fox reviewed the facility's Active Supervision Policy, which states: "Active supervision is defined as the ongoing process of watching, listening, and engaging with children to ensure their safety. It requires full awareness and active presence at all times. The following expectations apply to all staff:" "Active Presence: Teachers must be actively circulating throughout the classroom..."
Based on the information provided, Child A and Child B were unobserved on the premises when they touched their own and each other's private areas with their pants on and partially off, in different locations near their cots, during naptime, off and on, for approximately seven minutes while the caregiver in the room was less than ten feet away.
