On March 5, 2026, the Office of Childhood (OOC) received a report alleging that every time a parent picks up or drops off child, there are babies sleeping on bouncer chairs, on the floor, or in the swings. After conducting the investigation, Compliance Inspector (CI) Curtis West finds the allegation is substantiated. This conclusion is based on the following evidence of a licensing rule violation that occurred at the facility:
5 CSR 25-500.092(1)(B)2. I., which states "Sitting devices such as car safety seats, strollers, swings, infant carriers, infant slings, and other sitting devices shall not be used for sleep/nap time. Infants who fall asleep anywhere other than a crib, portable crib, or playpen shall be placed in the crib or playpen for the remainder of their sleep or nap time."
On March 6, 2026, CI West conducted an unannounced inspection and interviewed Caregiver Melissa Divi and Caregiver Jamie Tolliver. Melissa stated that she has seen lead teachers allowing the fussier infants aged 12 months old and younger to fall asleep and remain sleeping on bouncer chairs, on the floor, or in the swings. She was instructed to allow the fussier infants to remain sleeping in the bouncy swing. Jamie stated that she has seen infants who were allowed to remain sleeping in the swings or on the floor. She was instructed by Lacey that a few of the infants will get fussy if you put them in the crib after they fall asleep.
