5 CSR 25-500.102(2)(A)2. Center directors and group child care home providers routinely shall be on duty during the hours of highest attendance a minimum of forty (40) hours per week. If the facility operates less than forty (40) hours per week, the center director or group child care home provider shall be on duty at least fifty percent (50%) of the operating hours.
5 CSR 25-500.222(6) Daily staff and volunteer attendance records shall be maintained and kept on file a minimum of one (1) year.
Conclusion Summary
On March 12, 2026, the Office of Childhood (OOC) received a report alleging that Director Breanne Poston is also the principal of Horace Mann Elementary School. After conducting the investigation, Compliance Inspector (CI) Cole Eddins finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.102(2)(A)2. -which states: "Center directors and group child care home providers routinely shall be on duty during the hours of highest attendance, a minimum of forty (40) hours per week. If the facility operates less than forty (40) hours per week, the center director or group child care home provider shall be on duty at least fifty percent (50%) of the operating hours." On March 18, 2026, CI Eddins interviewed Reporter Eliana Roshel. Eliana stated that Breanne Poston is acting as both the director of the daycare and the principal of Horace Mann Elementary School at the University. Breanne has been working both jobs since she was hired at the university, and there was no way she could spend 40 hours or more at both locations. On March 18, 2026, Compliance Inspector (CI) Cole Eddins completed an unannounced inspection and interviewed Caregiver Rachel Wood, Caregiver Julie Michaelsen, Caregiver Amber Bogel, Office Manager Alyssa Godsey and Chairperson of School of Education Nissa Ingraham. All staff members provided consistent information. All staff members stated that Breanne works as both the director of the daycare and the principal of the elementary school. Breanne works around 25 to 28 hours a week on average on the daycare side of the building. Alyssa and Nissa stated that Breanne is the facility's director, but she also works as the school principal. It is not possible for Breanne to work 40 hours consistently at the daycare side while also being the school principal. On March 18, 2026, CI Eddins conducted a walkthrough of the facility and observed no director on site. On April 1, 2026, CI Eddins interviewed Director Breanne Poston, who stated that she has worked as the facility director since June 2, 2025. Since June 2, 2025, she has also worked as the elementary school principal. On average, she spends around 25 plus hours at the facility and the remainder of her time at the elementary school. An additional violation was found during the course of this investigation: 5 CSR 25-500.222(6) - which states: "Daily staff and volunteer attendance records shall be maintained and kept on file a minimum of one (1) year." On March 18, 2026, CI Eddins conducted a walkthrough of the facility and did not observe any logged time for Breanne. On April 1, 2026, CI Eddins interviewed Director Breanne Poston, who stated that she does not keep her hours logged for the times she's at the daycare.
