Compliance Inspector (CI) Jessica Graham investigated the allegation that Child A, age 3-years-old has documented developmental needs and is eligible for services through an IEP. Due to transportation limitations (the daycare will not allow the bus to pick Child A up), he has not been able to access those services. As a result, his behavioral needs--including elopement--are known and ongoing concerns. The daycare facility is aware of these challenges, however, has never accepted a copy of Child A's Individual Education Plan (IEP) to better understand his needs. This allegation is substantiated based on the following rule violation.
5 CSR 25-500.132(6) which states: "A child who has a special physical, developmental, or behavioral need shall have on file an individualized plan for specialized care from a professionally qualified source."
AND
5 CSR 25-500.122(2)(A) which states: "The provider, within thirty (30) days following the admission of each infant, toddler or preschool child, shall require a medical examination report signed by a licensed physician or registered nurse who is under the supervision of a licensed physician and completed not more than twelve (12) months prior to admission. The provider may use the department's medical assessment form or the provider may use its own form if it contains all the information on the department's form. The Child Medical Examination Report (Infant/Toddler/Pre-School) form, revised 2021, is incorporated by reference in this rule, as published by the Missouri Department of Elementary and Secondary Education, PO Box 480, Jefferson City, MO 65102-0480 and available by the department at https://dese.mo.gov/childhood/forms. This rule does not incorporate any subsequent amendments or additions."
On May 4, 2026, Parent A stated Child A has an IEP but no paperwork has ever been submitted to the child care facility regarding his behaviors or medical issues.
On May 5, 2026, caregivers Julianna Johnson, Tiffany Ramsey and Hannah Stackley said that Child A has behavior issues and they have discussed issues with Parent A. Suggestions for services have been given to Parent A. They also informed Parent A that they would no longer walk Child A to board the bus for another program because he tries to run from them. They do not have a copy of Child A's IEP.
On May 5, 2026, CI Graham reviewed Child A's file and there was no medical examination report on file. Child A's enrollment form states that he has Level 2 Autism Spectrum Disorder and developmental delays so an individualized special care plan is needed.
